REGULATIONS OF THE Qπш LOYALTY PROGRAM [KU-PI-SH]


These regulations ("Regulations") define the conditions of participation in the loyalty program ("Program")
organized by Art Works Sp. z o.o. with its registered office in Łomianki at ul. Kampinoska 2, entered into the National Court Register by the District Court for the Capital City of Warsaw. Warsaw, 14th Commercial Division of the National Court Register under KRS number 0000047711, NIP 1181611037, REGON 017313591, with a share capital of PLN 61,000 fully paid up ("Organizer"), in the territory of the Republic of Poland.

I. DEFINITIONS:

In these Regulations, the following terms written with a capital letter have the meaning given to them below:
1.1. "Declaration" means an application for admission to the Program, completed by the Participant in accordance with the rules of the Regulations in electronic form or via the Online Store website
1.2. “Participant” means an individual who has been registered for the Program on a submitted basis
Declaration completed in accordance with the Regulations;
1.3. "Participant Account" means an account created for the details (name and surname, e-mail address) of the Participant
according to the rules.
1.4. "Boutiques" means the Organizer's stationary stores covered by the Program, run under the QПШ Robert Kupisz brand: Mokotowska 48 in Warsaw, Galeria Mokotów in Warsaw, Klif in Gdynia and Stary Browar in Poznań.
1.5. "Online store" means the QПШ Robert Kupisz online store run by the Organizer at the Internet address www.robertkupisz.com.
1.6. "Database" means the collection of personal data of Participants obtained in connection with their
joining the Program, the administrator of which, within the meaning of the Act, will be the Organizer;
1.7. "Act" means the Act of August 29, 1997 on the protection of personal data (consolidated text: Journal of Laws of 2016, item
922);
1.8. "Goods" means goods the purchase of which, in accordance with the Regulations, results in the charging of i
obtaining appropriate discounts.
1.9. "Balance" means the sum of all purchases made by the Participant, including returns
Goods.

II. GENERAL PROVISIONS:

2.1. A participant may be a natural person who is over 18 years of age and has full capacity to participate
legal actions.
2.2. Employees of the Organizer and members of the immediate families of the Organizer's employees (i.e. descendants, ascendants, siblings, adopted persons) cannot be Program Participants.
2.3. A Participant may have only one active Participant Account at a time. Any
Notifications to the Organizer referred to in these Regulations may only be made i
only by the Participant or a person holding the Participant's power of attorney.
2.4. The Participant is entitled to join the Program by making one-off purchases in
Boutique. The customer completes the form electronically, agreeing to join the program and registering his e-mail address as an identifier in the system.
2.5. You can also join the Program via the Online Store
marking the appropriate consent at the stage of placing the order
2.6. Joining the Program after completing the Declaration or submitting the Form is based on:
registration of the Participant by the Organizer after verifying whether the person completing the Declaration or
the person submitting the Form meets the requirements of the Regulations, and its Declaration or Form (fields required for
registration) are completed correctly.
2.7. These Regulations will be available, among others, in Boutiques, on the Organizer's website
robertkupisz.com and in system messages sent to the Participant as part of the program.

III. PERSONAL DATA:

3.1. The processing of the Participant's personal data takes place in accordance with the Act.
3.2. The Participant voluntarily provides the Organizer with personal data in connection with his/her participation in
Program and for purposes related to participation in the Program. These data are included in the Declaration, Form or other declarations submitted to the Organizer. The participant has the right to view his or her data and request that it be updated or corrected.
3.3. Personal data are entered into the Database.
3.4. If possible, the Participant should immediately notify the Organizer of any change in his or her personal data. The Participant may report changes by phone or correspondence to the Customer Service Office.
3.5. The participant may consent to the processing of data to a wider extent than indicated above.

IV. GRANTING DISCOUNTS:

4.1. The Organizer grants the Participant a discount for purchasing Goods or Services in Boutiques and in the Store
Online for the amount specified in the Regulations. Purchase amounts are calculated from the first transaction
Participant after registering in the Program in accordance with the Regulations or in the case of Customers who
have expressed their commercial consent earlier, purchase amounts will be counted from November 1, 2016.
4.2. Additionally, additional discounts may also be granted to the Participant's Account as part of promotional and bonus programs offered by the Organizer in accordance with the principles set out in the Organizer's information materials regarding such programs.
4.3. The condition for registering purchases on the Participant's Account is to provide the e-mail address or name and surname provided by the Participant to the Boutique employee when making purchases in the Boutique, before the Participant purchases the Goods or Service covered by the Program (before closing the transaction). The purchase amount is added to the Participant's Balance immediately after the transaction.
4.4. In the case of purchasing Goods in the Online Store, in order to register purchases, the Participant should log in using the e-mail address provided by the Participant when creating the Account. The basis for registering purchases is then the completion of the transaction. The transaction amount will be added to the Participant's balance after 15 days, taking into account the possible return of the purchased Goods.
4.5. Discounts will be credited to the Participant's Account as follows:
4.5.1. Discounts will be granted after purchasing Goods or Services in accordance with the principle:
a) in the case of purchase of Goods for a total amount exceeding PLN 10,000 gross - 5% discount for each
next purchases in the Online Store or Boutiques (STATUS GOLD)
b) in the case of purchase of Goods for a total amount exceeding PLN 20,000 gross - 10% discount on each subsequent purchase in the Online Store or Boutiques (STATUS BLACK)
4.6. If discounts have been issued or granted contrary to the Regulations, the Organizer will be entitled to invalidate the relevant discount from a given Participant's Account.
4.7. Discounts cannot be exchanged for cash and cannot be combined with other promotions offered by
Organizer.
4.8 The balance on the Participant's Account will be reduced if the Participant returns the purchased Goods to the Organizer.
4.9. The Participant is entitled to receive information about the status of his/her Participant Account and information
regarding discounts granted to the Participant's Account. The Participant can obtain information about the status of his/her Account in the "My Account" tab after logging in to the Participant's Account at robertkupisz.com or during a visit to the Boutique.
4/10 The Participant has the right to file a complaint if the amount of purchases is not credited to the Account
Participant. Complaints can be reported to the seller in the Boutique or sent to the Customer Service Office at the following address:
bok@robertkupisz.com or to the correspondence address: Loyalty Program Qπш [KU-PI-SH] ul. Cybernetyki 19A 02-677 Warszawa. In order to speed up the procedure, the Organizer asks to attach to the complaint a copy of the receipt confirming the purchase of the Goods or Services covered by the Program for which the Participant is submitting a complaint. Each such complaint is considered individually by the Organizer.

V. TERMINATION OF THE PROGRAM, EXCLUSION FROM THE PROGRAM:

5.1. The Organizer may refuse to register in the Program if:
5.1.1. The Participant does not meet the requirements of the Regulations;
5.1.2. The form is filled out incorrectly and does not contain the Participant's name and surname;
5.1.3. The Participant has not provided commercial consent in connection with his or her participation in the Program and for purposes related to participation in the Program;
5.1.4. The declaration is completed incorrectly, the Participant's data has not been confirmed.
5.2. The Organizer may terminate the Participant's participation in the Program upon notice if:
The Participant provided false data in the Declaration or Form.
5.3. The Organizer may also terminate the Participant's participation in the Program upon notice
in the event that the Participant is not active in the Program for a period exceeding 24 months, this term being understood as a situation in which the Participant has not made a purchase that has been registered on the Customer Account for a period of 24 months from the date of the last such entry.
5.4. The Participant may resign from participation in the Program at any time. After receiving written
notification in this regard, the Participant's Account will be closed.
5.5. In the event of termination of participation in the Program, the Organizer is entitled to close the Account
Participant and to invalidate all discounts granted to the Participant's Account.
5.6. The program is valid for an indefinite period. The program begins with an announcement about its commencement. The Organizer reserves the right to terminate the Program with 30 days' prior notice.
5.7. In the event of termination of the Program, the Organizer is obliged to include information about
termination of the Program's operation in the Boutiques and on the Organizer's website, as well as notifying Participants in the manner provided for in Chapter IX of the Regulations.

VI. CHANGES:

6.1. The Organizer is entitled to make changes to these Program Regulations with future effect.
6.2. In the event of any changes to these Regulations, the Organizer will notify each time
Participants about changes introduced to the Regulations by posting the text of the amended Program Regulations in Boutiques, on the Organizer's website and via other means of communication.
6.3. The amended Regulations will be effective after 30 days from the date of their announcement. If the Participant does not consent to the changes in the Regulations, he or she has the right to resign from participation in the Program before the changes come into force. This does not exclude or limit the Participant's right to resign from participation in the Program at any time.

VII. NOTICES:

7.1. Unless the Regulations provide otherwise, the notice is considered delivered to the Participant if it is sent by post to the address indicated in the Declaration or Form, or by e-mail to the e-mail address provided by the Participant entered in the Database. Any complaints regarding delivery in the manner specified in this point will be considered individually on the basis of
specific factual situation.
